1. Acceptance of Terms
By registering for a program, camp, academy, or workout session offered by Mitchell Kirsch Performance LLC ("Elevate Basketball," "we," "us," or "our"), or by using our website, you agree to these Terms of Service. If you are registering a minor for a program, you confirm that you are their parent or legal guardian and have authority to agree to these terms on their behalf.
2. Programs and Registration
Elevate Basketball offers basketball training programs, camps, academies, and small group workouts. Registration is completed through our website or designated payment links. You agree to provide accurate information during registration, including player name, grade level, and emergency contact information, and to keep this information current.
3. Payments
Full payment is due at the time of registration unless otherwise stated for a specific program. Prices are listed in U.S. dollars. We reserve the right to change pricing for future sessions or programs at any time, but changes will not affect a registration already completed.
4. Cancellations and Refunds
All sales are final. Elevate Basketball does not offer refunds for any program, camp, academy, or workout package once registration is complete, including in cases of voluntary withdrawal, missed sessions, or inability to attend. Exceptions may be granted solely at the discretion of Elevate Basketball ownership on a case-by-case basis. Any request for a refund exception must be submitted in writing to Elevate Basketball for review.
5. Assumption of Risk
Participation in basketball training involves inherent risks of physical injury, including but not limited to sprains, fractures, and other injuries common to athletic activity. Elevate Basketball considers managing and working through the physical demands of training, including the possibility of injury, to be part of an athlete's overall development. By registering, the participant (or their parent/guardian) acknowledges these risks and voluntarily assumes them. Elevate Basketball will take reasonable precautions for participant safety but is not responsible for injuries that occur during normal participation in training activities, except where caused by our gross negligence or willful misconduct.
6. Injury and Continued Participation
Elevate Basketball is committed to supporting athletes through all stages of their development, including recovery from injury. Athletes who experience an injury during a program are expected to remain committed to and engaged with the program. Coaches will work with the athlete to appropriately modify drills, workouts, and training intensity to accommodate the injury while it heals. Continued participation under modified activity does not entitle an athlete to a refund or program credit, consistent with Section 4 above. Participants and parents/guardians are responsible for informing coaches of any injury, medical restriction, or condition that may affect training.
7. Emergency Medical Care
In the event of an injury or medical emergency during a session, Elevate Basketball staff may seek emergency medical treatment for a participant if a parent or guardian cannot be immediately reached. You agree to reimburse any reasonable costs incurred in doing so.
8. Code of Conduct
Participants and parents/guardians agree to treat coaches, staff, and other participants with respect. Elevate Basketball reserves the right to remove any participant from a program without refund for conduct that is unsafe, disruptive, or disrespectful.
9. Photo and Video Release
Elevate Basketball may take photos or videos during training sessions for use in marketing materials, social media, or our website. By participating, you consent to this use unless you notify us in writing that you decline.
10. Limitation of Liability
To the fullest extent permitted by law, Elevate Basketball's total liability arising from any program or service will not exceed the amount paid for that specific program.
11. Changes to These Terms
We may update these Terms of Service from time to time. Continued registration for or participation in our programs after changes are posted constitutes acceptance of the revised terms.
12. Governing Law
These terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles.
